McArthur: FAI system is “dangerously flawed”

Scottish Liberal Democrat justice spokesperson Liam McArthur MSP has today called on the government to “urgently and comprehensively” reform the FAI system, after the Justice Committee published its letter to the Lord Advocate raising questions about the resourcing and effectiveness of the FAI system in the wake of Allan Marshall’s death.

Liam McArthur said:

“The horrific death of Allan Marshall has shone fresh light on the dangerous flaws in Scotland’s fatal accident inquiry system.

“Many families in a similarly tragic situation have endured long waits for basic answers on the fate of their loved ones. Dragging out that pain and anguish for years is cruel and unacceptable and it also stops the prison service and other public bodies from learning lessons that can save lives.

“Research by the Scottish Liberal Democrats exposed an FAI system that needs to be urgently and comprehensively reformed. This case adds to the mounting evidence in support of that call.

“Backlogs and barriers in the system are preventing effective reflection and the implementation of important changes. If this continues there will be more preventable deaths in the future. That should weigh heavily on the mind of the Justice Secretary and spur him into action.”
