Interception of Communication in Scotland

  1. Conference deplores reports that legally privileged consultations between lawyers and those accused of criminal offences may have been intercepted or monitored by police or other agencies.
  2. Conference is concerned that such interception or surveillance may result in the convictions of those convicted of serious criminal offences being overturned.
  3. Conference notes that under the Regulation of Investigatory Powers Act 2000 Warrants for the Interception of Communications are authorised by Scottish Ministers for the purpose of detecting or preventing serious crime in Scotland.
  4. Conference endorses the policy of the Federal Party that all warrants for the Interception of Communications should be approved by judges not politicians.
  5. Conference calls on the Scottish Government to bring forward legislation to replace the authorisation of Warrants for the Interception of Communications by Scottish Ministers by a system of independent judicial oversight where intercept warrants are authorised by a High Court Judge or Sheriff Principal.
